Terms & Conditions

These general terms and conditions of sale define the contractual relationship between:  

BIJOUX COQUETTE

and

Any natural person making a purchase on the website,
hereinafter referred to as the “Customer”.




1. TERMS AND CONDITIONS GOVERNING THE PLACING OF ORDERS

All natural persons making a purchase declare that they are 18 or over and
that they have full legal capacity or, failing this, parental authorization to contract in this way.

All purchases are made in a personal capacity only. 

No purchases may be made for professional purposes linked to a Customer’s business. 

Sales may not be concluded with legal entities.


2. CONCLUSION OF THE CONTRACT ORDERS

Any general terms and conditions conflicting with or derogating from the sale provisions
defined in this contract are invalid and no exceptions of any kind may apply.
Accordingly, Customers may not rely on any conflicting document to enter into or terminate their contract. 

Orders must state all appropriate information required for their processing,
failing which the relevant order will not be accepted or processed.

By placing an order on the BIJOUX COQUETTE website, Customers are deemed to have read and accepted
these general terms and conditions of sale and may not refute them in the event of a dispute.

The general terms and conditions of sale applicable in connection with an order for an item
or items are those in force at the time each order is placed. 

By clicking on “purchase”, Customers send and validate a binding order
for the item or items in their basket. 

Confirmation of receipt of the order shall be sent immediately after the placing of the order,
containing a summary of the order, the delivery address and the billing address.
This confirmation constitutes acceptance of the order. 

A binding sale contract is entered into whenever BIJOUX COQUETTE sends confirmation of an order.
The sale shall be governed by the general terms and conditions of sale defined in this contract. 

Both the data provided by the Customer and BIJOUX COQUETTE's order confirmation
shall be retained as proof of the transaction. 

BIJOUX COQUETTE reserves the right to refuse any order or delivery,
in particular in the event that rare components used to produce certain pieces are out of stock,
a payment by debit or credit card is refused or in the event of non-payment.
 

3. ITEMS

Items sold on the website are described and presented as precisely as possible.
The photographs illustrating the items aim to reproduce the items on sale
as accurately as possible and accordingly, they are provided for information purposes
only and do not form part of the contractual agreement. 

Uneven finishing and differences in size and/or coloring may be found in handcrafted and unique pieces.
These are inherent to this type of production (handmade) and may not be treated as major or manufacturing defects. 

Accordingly, BIJOUX COQUETTE may not be held liable in this respect
and the validity of the order may not be affected on this ground.


4. ITEM AVAILABILITY

BIJOUX COQUETTE wishes to specifically draw the Customer’s attention to the fact that
each item is a unique handmade creation, made to measure and to order. 

BIJOUX COQUETTE does not hold a stock of readily available items.
Instead, it focuses on producing meticulous handcrafted items for each order
to ensure that its customers are fully satisfied. 

Accordingly, between 3 to 6 weeks should be allowed for the delivery of all orders
depending on the period and the complexity of the requested items. 


5. PRICES

Selling prices are stated in Swiss Francs (CHF), excluding Swiss VAT and delivery charges. 

Items are invoiced on the basis of the price lists in force at the time the order is recorded. 

BIJOUX COQUETTE reserves the right to modify its prices at any time.  

Customers are informed of the applicable delivery charges whenever an item is added
and at the time of the final validation of their order.


6. PAYMENT

BIJOUX COQUETTE uses the PayPal platform to manage payments,
in order to ensure a high level of security for Customers and to facilitate their payments.

This platform may be used even if a Customer does not have an account and/or does not wish to create an account.
No account is necessary and no account will be created.
Customers will only be asked to provide certain pieces of information required to place their order
and pay for it in a highly secure environment. All information will be treated as strictly confidential. 

PayPal accepts all major credit and debit cards and payments from bank accounts. 

The amount owed by the Customer is the amount stated in the order confirmation.

The price is payable in full. Partial payments are not accepted. 


7. DELIVERY

Customers, whether residing in Switzerland or elsewhere,
are required to pay separate delivery charges in addition to the amount of the item or items ordered. 

For deliveries to places located outside of Switzerland, the Customer is solely liable
for the payment of all import duties, if any, or customs duties payable in connection with the order. 

Parcels are sent priority by the Swiss postal service, with signature confirmation requested,
along with the relevant invoice, to the delivery address stated by the Customer. 

In the event that the billing address and the delivery address are different,
the invoice will only be sent to the billing address.
The parcel will be sent to the address stated by the purchaser. 

Purchasers are solely liable for ensuring that the delivery address supplied for the order is accurate and complete.
BIJOUX COQUETTE may not be held liable in the event of an incorrect or incomplete address. 

Delivery times may be extended, by a reasonable period, if a force majeure event prevents delivery,
in particular in the following cases: strikes, wars, natural disasters,
shortages in the raw materials used to produce the jewelry and transport problems.
Bijoux Coquette may not be held liable for these events or for their impact on the delivery times for these parcels.
Force majeure events may not be used as a ground for terminating the sale contract. 

BIJOUX COQUETTE delivers internationally.


8. RETURNS & REFUNDS

Most of BIJOUX COQUETTE items are non-returnable.

Returnable items: one size items (necklaces, earring, pendants).

Non-returnable items: made to measure items (rings, bracelets, any special order items).

In order to obtain a full refund, Customers must return returnable items within a period of 30 days.
This period begins on the date the parcel has been purchased by the Customer.

If the Customer fails to return the product within this period, it may still be returned but the Customer
will not be entitled to a refund of either the price of the item or items or the costs incurred for the return.

Only the price of the ordered item or items will be refunded.

No refund will be given for any costs (delivery charges, taxes, custom duties or fees etc.)
incurred by the Customer to receive the goods. 

Customers shall bear all costs incurred in connection with returning the products they ordered. 

Customers are responsible for selecting the best way to return the product and are fully liable
for ensuring that the item or items are carried in such a way as to be returned within the prescribed period. 

In order to be eligible for a refund,following requirements must be met: 
1. The item or items must not have been worn, used, modified, washed or damaged.
2. The item or items must have been returned in their original packaging along with the purchase invoice. 

No refund will be given if the Customer fails to meet these above-mentioned additional requirements in full. 

A refund may also be given if an item is sent by mistake instead of the item ordered by the Customer or
if an accepted manufacturing defect affects the product. In these two cases, to the exclusion of all others,

BIJOUX COQUETTE undertakes to refund the selling price of the item or items paid by the Customer.

However, in order to be eligible for a refund, any mistake or defect must be notified to BIJOUX COQUETTE
within 48 hours of receipt of the order.

 

 

9. INTELLECTUAL PROPERTY, PERSONAL DATA

All information published on the website (text, photos, logos etc.) is protected by intellectual property rights
and is strictly reserved for BIJOUX COQUETTE, the sole and exclusive holder thereof. 

Accordingly, none of this information may be reproduced, republished, modified,
commercially exploited or reused in any manner whatsoever without BIJOUX COQUETTE’s prior consent.

All personal data collected shall be processed with the utmost respect and in strict confidentiality.
It shall not be used for commercial purposes. However, some of the data relating to the delivery of the ordered item
or items may be transferred and entrusted to our order fulfillment and shipping partners. 

 

10. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

BIJOUX COQUETTE reserves the right to unilaterally amend
these general terms and conditions of sale and to update them, where necessary. 

 

11. TRANSLATIONS AND INTERPRETATION

In order to make the legal framework in which BIJOUX COQUETTE operates more readily understandable
for its international customers, these general terms and conditions of sale have been translated into English.

However, if a dispute arises between BIJOUX COQUETTE and one of its international customers
owing to a translation or different interpretation of one or more terms of this contract,
the original French version shall prevail. Only the said French version may be consulted and applied. 

 

12. CHOICE OF FORUM

All clauses set out in these general terms and conditions of sale,
as well as the purchase and sale transactions referred to herein, shall be governed by Swiss law. 

The Courts of Lausanne in Switzerland shall have jurisdiction.
